DEFINITIONS

 

“Website” or “Site” includes the TLD theviewpointtours.com, also accessible through the URLs viewpoint-tours.com, viewpointtours.pt and viewpoint.tours; “Client” or “Participant” is defined as any single or collective entity to which Extreme Adrenaline, Lda. (Hereinafter “the Agency”) provides its travel organization services under the name Viewpoint Tours; “Tour Leader”, is an experienced traveller and photographer who represents the Agency in the field during the tour. It is also responsible for implementing the values and policies of the company, as well as guaranteeing the provision of the service acquired by the Client

OBJECT AND ORGANIZATION

Extreme Adrenaline, Lda., is a limited liability company with headquarters in Estrada de São Bernardo, 375, Aveiro, registered in the Commercial Registry of Aveiro, with the unique registration and registration number  (VAT ID) 514874589 registered by the National Registry of Travel Agencies and Tourism (Registo Nacional de Agências de Viagens e Turismo or RNAVT) with the No. 7839. These Terms and Conditions are designed to establish the terms and conditions governing the provision of travel services organized by the Agency and for the Client. These Terms and Conditions may be extended, cancelled or changed by the programs and conditions specifically defined for each tour. By subscribing the Agency’s services for a tour, the Client agrees to accept and be bound by all terms, conditions and definitions set forth in these Terms and Conditions, as well as the specific conditions of the subscribed tour, program or service.

ACCOUNTABILITY

 

The accountability of the Agency in all its commercial activities and in any way related with travel management is guaranteed by a Civil Liability insurance policy (by Allianz Portugal) and by the Portuguese Tourism and Travel Guarantee Fund (Fundo de Garantia de Viagens e Turismo), under the terms of the law.

I. BOOKING PROCEDURE

BOOKING AND PAYMENTS

 

The booking or reservation, and resulting place or seat on a tour will only be validated after the total payment of the tour or after the payment of the pre-defined reservation fee (usually 10% of the total cost of the tour). The Client accepts all responsibility for paying the due and necessary amounts in the pre-defined schedules stated by the Agency. All dates and payment requirements are clearly specified on the booking page for each tour but are also present in the emails sent to the Client after the reservation request. Viewpoint Tours reserves the right to cancel any reservation that does not meet the conditions described above.

CLIENT/PARTICIPANT ACCOUNTABILITY

 

Upon completion of a booking or reservation, the Client/Participant declares that:

  • Knows and accepts the contents of these “Terms and Conditions”;
  • Acknowledges and accepts any changes to these Terms and Conditions that may explicitly and in due time be declared by the Agency;
  • Is an adult (18 years of age or older) and legally independent;
  • Knows the full extent of the details of the booked tour, including the physical, emotional, social and technical requirements of the tour;
  • Knows that the booking will only be considered validated after payment of the booking fee;
  • Is fit enough to travel;
  • Knows and accepts that immediate medical care is sometimes impossible in certain places where tours are taking place;
  • Accepts the fact that because of force majeure (acts of God, war, labor strikes, earthquakes, floods, etc.), some tours end earlier than expected;
  • Knows that if the tour becomes excessively demanding, the Client/Participant may be advised to stay in the accommodation during daily activities;
  • Although all tours are guided and organized by experienced travelers who are also photographers (Tour Leaders), a tour is not a training session, course or workshop;
  • Any equipment lost or damaged by the Client/Participant during the tour is of his own accountability

MINIMUM AGE

 

The Agency can only provide services to individuals who are at least 18 years old and legally independent. Persons under the age of 18 can be integrated into the group under very specific conditions and only if accompanied by one or both parents or guardians and in accordance with the legal requirements.

INFORMATION COLLECTION

 

The Agency may need to require the Client/Participant to provide personal information, such as passport details, personal identification details, vaccination records, food allergy reports, relevant health issues and/or any other sensitive information. The Client/Participant, of course, has every right not to deliver this information. However, if the Client/Participant does not comply with all information requests – to the extent reasonable and justified – the Agency reserves the right to cancel the Client/Participant booking. In addition, the Client is always responsible for arranging all the documentation necessary for the booked tour. DOCUMENTATION (GENERAL ASPECTS)

 

The Client must have all personal documentation in good order (citizen’s card, passports, visas, vaccines and others that may be required). The Agency declines any responsibility for the refusal of the granting of visas or non-admission of the Client in a foreign country; In these cases, the conditions established for the cancellation of the tour shall apply, and the client shall be responsible for any and all cost situation entail. The Client who is a non-European citizen must have all the necessary documentation (passport, visa, residence permit, etc.) to travel or transit within the European Union according to his or her nationality. For travel in whole or in part outside the European Union, visas or other special documentation may be required. The Client should always consult the Embassy or Consulate of the countries of destination. In no case shall the Agency be liable, directly or indirectly, for the refusal to grant visas or non-entry in any country.

II. FLIGHTS

FLIGHTS BOOKINGS AND SCHEDULE

 

The Agency terminated all flight reservation services on August 15, 2018.

CLIENT/PARTICIPANT FLIGHTS BOOKING

As a precautionary measure, the Client/Participant should only book its flights after the tour has been confirmed by the Agency. The Agency cannot be held liable for any losses (financial or otherwise) if the Client reserves its own flights 45 days or more before the departure date and the tour is cancelled.

DOCUMENTATION FOR THE FLIGHT

 

The Client/Participant is responsible for any customs problems derived from invalid identification documents or passport. The Client/Participant is responsible for any complications resulting from the transportation of prohibited or illegal substances in his/her cabin or hold baggage.

III. TOUR SPECIFICITIES

Accommodation

 

The Agency clearly describes all accommodation expected for each tour on the corresponding tour webpage. All options, supplements and alternative accommodations are contemplated and detailed in advance. The Agency can make use of hotels, hostels, houses, cabins, cottages, camping tents or a mix of several. The Client/Participant has access to all information on the tour web page.

MEETING POINTS

 

The meeting points are set in advance and usually stated in a list published on the tour web page (check the travel information in the header). Due to certain restrictions and the needs of the Client/Participant, meeting points may be assigned to locations other than those originally stipulated. The most common meeting point is usually an airport.

LANGUAGE

 

English and Portuguese are currently the languages available for the tours.

 

MINIMUM NUMBER OF CLIENTS / PARTICIPANTS

 

Each tour is structured with a minimum number of Participants definition (see “Available groups” in each header of the tour webpage). If this number is not reached, the Agency will cancel the tour and notify the Client/Participant by email at least 40 days before the date of departure. The Client/Participant shall at this time be reimbursed for all payments made to the Agency and no other duty of refund and/or liability shall be attributed to the Agency.

CHANGES ON BOOKED TOURS AND TOURS DATES BY CLIENT REQUEST

 

The Client/Participant may not change a reservation from one tour to another, or even from one date to another within the same tour. Some special conditions may allow such change, but only after due validation and written consent issued by the Agency. Administrative fees may apply. Check the “Cancellations” section for more information.

TRANSMISSION OF SEAT/BOOKING (CLIENT TO CLIENT)

 

The Client/Participant may transfer their booking to another person, provided that this process and due notification occurs 61 or more days before departure. The new Client/Participant is subject to the same “Terms and Conditions” as the original Client/Participant. If the new Client is of a different gender from the original, a supplement for individual accommodation may be required and mandatory. If individual accommodation is not available, the Agency reserves the right not to accept the transfer of seat/booking.

IV. ITINERARIES

ITINERARIES

 

Viewpoint Tours operates on tours and photo tours that require a special and specific approach to the most popular Points of Interest (hereinafter “POIs”) as well as for “secret” locations, adequate time of day, effort management, etc. Our itineraries are what sets us apart from a regular travel agency (adventure or otherwise) and represent thousands of euros and hours invested in such places. Regarding this matter, we reserve the right to only make our itineraries absolutely “public” once we are sure that the Client/Participant has serious and real interest in travelling with the Agency. The Client/Participant accepts that payment of the reservation fee does not grant access to the full itinerary and operational details. These will be fully revealed later.

CHANGES TO THE ITINERARY

 

The Agency or our Tour Leaders on the field may be forced to make changes to the pre-defined itineraries, departure and arrival times, scheduled activities, transportation, accommodation, meals, shopping points, etc. Force majeure (acts of God, war, labour strikes, earthquakes, floods, etc.), operational efficiency or the strategic approach of the company or tour leader, are considered legally valid motives. The Agency reserves the right to operate such changes if the alternatives chosen are of the same category or value and if operationally similar.

NON-COMPLIANCE

 

If, for any reason imposed by third parties or due to force majeure (acts of God, war, strikes, earthquakes, floods, etc.), the Agency becomes unable to fulfill any essential service defined for the tour, the Client/Participant has the right to cancel the reservation, being refunded of all payments made in favor of the Agency, except for the reservations of flights already paid to the operators. As an alternative to a full refund, the Client/Participant may suggest or accept an alternative tour, being refunded by any disparity in value.

V. CANCELLATIONS

CANCELLATIONS SCHEDULE, RATES AND CANCELLATION BY CLIENT REQUEST

 

The timing and cancellation fee for cancellations requested by the Client/Participant are as follows:

  • Up to 91 days before departure: The Client/Participant only loses the reservation fee (normally 10%);
  • 90 to 61 days before departure: (+ 20%) 30% of the total tour;
  • 60 to 51 days before departure: (+ 20%) 50% of the total tour;
  • 50 days or less: 100% of the total tour.

For flights booked by the Agency on behalf of the Client/Participant, the reimbursement always depends on airlines and their own policies or terms and conditions. The Agency will request reimbursement from the airline and pass it on to the Client/Participant but reserves the right to charge an administrative fee of a maximum of 20% of the total cost of the flight. The refund may in some cases be made directly by the airline to the Client/Participant.

REFUND

 

The Client/Participant is not entitled to any refund for services not used during the tour, considering that they were not used by their own choice or decision. If the use of the services defined for the tour is not available for use by the Client/Participant due to circumstances resulting from the Agency’s duty and responsibility, the Client/Participant shall be entitled to be reimbursed for the services not provided during the tour.

VI. PRICE & COST

 

CHANGES ON TOUR COSTS

 

The prices defined by the Agency are most times based on the operating cost for an exchange rate defined between the EUR and a second currency. Exchange rates can sometimes fluctuate considerably, promoting changes that are relevant to the cost of operation. The Agency reserves the right to change the price of a tour if the cost of the operation approaches or exceeds what the Agency charges for the service. The Client/Participant will be notified by e-mail in a timely manner and will have the chance to accept the new price or cancel its reservation. In the latter case, the Client/Participant is entitled to a full refund of all payments made in favour of the Agency except for flight reservations already paid to airlines and operators. See the “FAILURE” section for details about refunds.

VAT

 

All prices shown on our website include VAT.

 

PAYMENT OPTIONS

 

The Client may pay for the services provided by the Agency through Paypal (Visa, Mastercard, American Express, etc.), bank transfer (preferential method) or any others, provided they have previously agreed with the Agency.

VII. MISCELLANEOUS ISSUES

BAGGAGE

 

In no circumstance shall the Agency be accountable for the luggage and other assets that the Client/Participant carries with him, regardless of the place or means of transportation used. The Agency recommends the subscription of baggage insurance. The Agency also recommends that the Client/participant shall always be present during baggage loading and unloading. In case of any sort of problem with the baggage, the Client shall immediately make a complaint (in the written form) to the service provider and/or entity in whose custody the baggage was deposited, keeping a copy of the claim. In international transportation, in case of luggage damage, the complaint must be made in written immediately after the confirmation of damage, and within a maximum of 7 days from its delivery. In the event of mere delay in the delivery of the luggage, the claim must be made within 21 days from the date of delivery. The presentation of the complaint will be essential for triggering the responsibility of the Agency over the entity providing the service.

TRAVEL INSURANCE

 

The Agency recommends purchasing travel insurance. The insurance must be adjusted for the duration of your tour, destination and type of activities.

 

CLAIMS

 

All complaints must be submitted in written form, by registered letter, within 20 days after the end of the tour. All complaints must be complemented and supported by a proof of complaint addressed to the service provider (hotel, Tour Leader, local partner, activity organizer, etc.).

 

APPLICABLE LAW

 

All disputes arising from the interpretation or execution of these Terms and Conditions will apply to Portuguese law. Any conflict arising from service agreement governed by these Terms and Conditions will be settled by the Judicial Court of Aveiro, with express waiver of any other. For all matters not regulated by these Terms and Conditions, the Portuguese Law will apply.
